KasiPicks Terms of Service

These Terms of Service govern your use of the KasiPicks website and any purchases made through our online store.

KasiPicks is a trading brand of KasiVolt (Pty) Ltd. By accessing our website, placing an order, or using our services, you agree to these Terms of Service.

1. Use of Our Website

You may use our website for lawful personal and commercial shopping purposes.

You agree not to:

  • misuse the website;
  • interfere with its security or operation;
  • attempt to gain unauthorised access to our systems;
  • submit false or misleading information;
  • use the website for unlawful purposes.

We may suspend or restrict access where misuse is suspected.

2. Products and Availability

We aim to display product descriptions, images, colours, features and specifications as accurately as possible.

However:

  • colours may appear slightly different depending on your screen;
  • packaging may vary;
  • product availability may change;
  • minor product improvements may result in small design differences.

All products are subject to availability.

We reserve the right to limit quantities, discontinue products, or correct product information where necessary.

3. Pricing

All prices displayed on the website are shown in South African rand (R) unless otherwise stated.

We may update prices, discounts and promotions at any time.

If a product is listed at an incorrect price due to an obvious error, we may contact you before fulfilling the order.

Nothing in these Terms removes any rights you may have under South African consumer law.

4. Orders

Placing an order does not automatically mean that we have accepted it.

An order is accepted once:

  • payment has been successfully authorised; and
  • the order has been confirmed for processing.

We may cancel or refuse an order where:

  • payment is unsuccessful;
  • the product is unavailable;
  • incorrect information was provided;
  • fraud or suspicious activity is suspected;
  • there is an obvious pricing or product-information error.

Where an order is cancelled after payment has been received, an appropriate refund will be processed.

5. Payments

Payments are processed through the payment methods made available on our Shopify store.

You are responsible for ensuring that:

  • your payment information is correct;
  • you are authorised to use the selected payment method; and
  • sufficient funds are available.

KasiPicks does not store full payment-card details where these are processed by third-party payment providers.

6. Shipping and Delivery

We currently deliver to eligible addresses within South Africa.

Delivery times shown on the website are estimates unless specifically stated otherwise.

Delivery may be affected by:

  • courier delays;
  • public holidays;
  • incorrect delivery details;
  • remote-area delivery;
  • weather or transport disruptions;
  • circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address.

Our separate Shipping & Delivery Policy forms part of these Terms.

7. Returns and Refunds

Returns, refunds, faulty products and exchanges are handled according to our Return & Refund Policy and applicable South African law.

Where applicable, consumers may have rights under:

  • the Consumer Protection Act 68 of 2008; and
  • the Electronic Communications and Transactions Act 25 of 2002.

Nothing in these Terms is intended to remove or reduce your statutory consumer rights.

8. Product Use and Safety

You are responsible for using products:

  • according to the instructions provided;
  • for their intended purpose;
  • with appropriate care and supervision.

Where a product includes electrical, mechanical, sharp, heated, pressurised or other potentially hazardous components, customers should follow all supplied warnings and safety instructions.

KasiPicks is not responsible for damage caused by misuse, unauthorised modifications, improper handling or failure to follow product instructions, except where liability cannot legally be excluded.

9. Product Information

We make reasonable efforts to ensure product information is accurate.

Some product specifications may be based on supplier or manufacturer information.

If a material error is identified, we may correct the listing.

If the error affects an order already placed, we will contact the customer where appropriate.

10. Promotions and Discount Codes

Promotions, discount codes and special offers may:

  • have expiry dates;
  • have minimum-spend requirements;
  • apply only to selected products;
  • be limited to one use per customer;
  • not be combined with other promotions.

We may withdraw or modify promotions where legally permitted.

11. Intellectual Property

All KasiPicks branding, logos, graphics, website content, advertising material, product photography created by us, and original written content remain the property of KasiPicks or the relevant rights holder.

You may not reproduce, distribute, copy or commercially use our content without permission.

12. Third-Party Services

Our website may rely on third-party services including:

  • Shopify;
  • payment processors;
  • courier companies;
  • analytics platforms;
  • advertising platforms;
  • social-media services.

Your use of those services may also be subject to their own terms and privacy policies.

13. Privacy

Personal information is handled in accordance with our Privacy Policy and applicable South African privacy law, including the Protection of Personal Information Act 4 of 2013 (POPIA).

By using our store, you acknowledge that certain personal information may be processed for purposes such as:

14. Limitation of Liability

To the maximum extent permitted by law, KasiPicks and KasiVolt (Pty) Ltd will not be liable for indirect, incidental or consequential losses arising from use of the website or products.

This clause does not exclude or limit liability where South African law does not allow such exclusion.

We do not guarantee that the website will always be available without interruption.

The version published on our website at the time of use or purchase will apply, subject to applicable law.

Material changes may be reflected by updating the “Last updated” date.

These Terms are governed by the laws of the Republic of South Africa.

Any dispute will be handled in accordance with applicable South African law and any consumer-protection rights available to the customer.
